This Privacy Policy provides information on the collection, use, and sharing (collectively referred to as ‘processing’ or ‘process’) of personal information by KQLD, LLC, AWESOME DAWESOME, LLC and ATL Gold, LLC t/a Dominique Dawes Gymnastics Academy (“Company”, “we” or “us”) in connection with your use of Company’s websites, including all subdomains, and social media pages that link to this Privacy Policy, and any member portals that we may make available (collectively, “sites”), your interactions with us when you attend our facilities, make purchases from us, attend Company events, and in the context of other online or offline sales and marketing activities. This Privacy Policy also explains the privacy rights you have in relation to these processing activities.

This Privacy Policy is incorporated into, and is part of, our Terms of Service. This Privacy Policy does not cover data or information we receive from third parties, and it does not cover third party products and services.

By accessing the sites or by otherwise interacting with us, you agree to be bound by this Privacy Policy. If you do not agree to the terms of this Privacy Policy, please do not use the sites or provide us with your personal information. Each time you use the sites, the current version of this Privacy Policy will apply. Information We Collect

We collect two types of information: “personal information,” which is information that can be used to identify you (such as your name, address, email address, or business contact details), and “aggregate information,” which is information that cannot be used to identify you (such as frequency of visits to the sites and your browser type).

Information You Provide to Us

We collect personal information that you voluntarily provide to us when you use our sites or otherwise interact with us.   • parent/guardian names, physical addresses, email addresses, telephone numbers, and mobile phone numbers;
  • student/participant names, ages, birthdates, and gender;
  • emergency contact information;
  • health and medical information, including allergies, medical conditions, physical limitations relevant to participation in gymnastics activities, and emergency medical treatment authorizations;
  • photographs and videos of students participating in classes, camps, competitions, and events;
  • transactional data, including products and services ordered, financial details and payment methods;
  • unique IDs such as your mobile device identifier or cookie ID on your browser;
  • IP address and information that may be derived from IP address, such as geographic location;
  • information about a device you use, such as browser, device type, operating system, the presence or use of “apps”, screen resolution, and the preferred language; and
  • behavioral data of the internet connected computer or device you use when interacting with the sites, such as advertisements clicked or viewed, sites and content areas, date and time of activities or the web search used to locate and navigate to a site.

Certain online information about you or device information may originate from the use of cookies and similar technologies (for example, pixel tags and device identifiers) on our sites or sites of third parties. Information We Automatically Collect

When you use our sites, we automatically receive and collect information, including personal information, from your device. This includes the following:

  • Information about your device, such as the operating system, hardware, system version, Internet Protocol (IP) address, device ID, and device language.
  • Your country and general location, time zone, and language used.
  • The specific actions that you take when you use our sites, including but not limited to the pages and screens that you view or visit and how you interact with our sites.
  • The time, frequency, connection type, and duration of your use of our sites.

Video and Audio

We use surveillance cameras at our facilities for safety and security purposes. We have partnered with Spot TV, a third-party service provider, to provide live video streaming of classes that parents and guardians can access through a secure web login. Video captured through this system may be used for safety monitoring, training, and management purposes. We may also take photographs at our locations in connection with our programs and activities. Images and recordings captured through these means may contain your likeness or that of your child. Photographs and videos of participants may be used for marketing, advertising, promotional purposes, press releases, social media, and on our website.

Social Media

We maintain social media pages on third-party platforms such as Facebook and Instagram. When you interact with our social media pages, the social media platform may collect information about you in accordance with its own privacy policy. We may also receive certain information about you from the social media platform, such as your name, profile picture, and any information you choose to make public. Please review the privacy policies of the social media platforms you use to understand how they collect and use your information.

Member Portal

We offer a member portal that allows parents and guardians to manage their accounts, enroll students in classes and programs, view schedules, make payments, and communicate with us. When you use our member portal, we collect the information you provide, including account credentials, student enrollment information, and any communications you submit through the portal.

Payment

If you make payments on or through our sites or member portal, your payment information (e.g., credit or debit card type, number, and expiration date) and related information (e.g., billing address) may be collected by our third-party payment processors. We do not store your full payment card details on our systems. We may receive limited transaction details from our payment processors to maintain records of your transactions with us.

Employment

If we have collected your personal information in response to a job opening, you are giving us permission to use and retain your personal information for the purpose of evaluating your application for employment consideration for the specific position that you applied to, as well as other roles at Company. This personal information may be processed and stored by a third-party talent tracking solution provider as well as with vendors, consultants, and other service providers who need access to such information to carry out work relating to the recruitment process on our behalf.

Aggregate Information Collected

Aggregate information is information that does not identify you. Aggregate information may be collected when you use our sites, independent of any information you voluntarily enter. Additionally, we may use one or more processes to de-identify information that contains personal information such that only aggregate information remains. We may collect, use, store, and transfer aggregate information without restriction.

Cookies and Similar Technologies

We may use cookies, pixel tags, web beacons, and other similar tracking technologies (“tracking technologies”) to automatically collect information through our website. Tracking technologies are essentially small data files placed on your computer, tablet, mobile phone, or other devices that record certain pieces of information when you visit our website. We may use these tracking technologies to help identify irregular behavior, prevent fraudulent activity and improve security, as well as making it possible for you to save your preferences and help us understand how you interact with our website.

CallRail assigns unique phone numbers to different marketing sources and may collect information such as caller phone number, call duration, and call recordings (where permitted by law). We use analytics tools, including Google Analytics, to evaluate the use of our website and measure the performance of our marketing efforts. Service Providers

For example, we may share personal information with third-party service providers for order fulfillment, analytics, call tracking and marketing attribution, event/campaign management, website management, information technology and related infrastructure provision, customer service, e-mail delivery, SMS text message delivery, auditing, and other similar service providers in order for those service providers to perform business functions on behalf of Company.

Digital Advertising Partners

When we engage in digital advertising, we may share the following categories of personal information with advertising partners: personal identifiers (including name, email address, telephone number, IP address and unique device identifiers); internet or other electronic activity information (including pages visited, session and campaign attribution data, and marketing engagement events); and approximate geolocation derived from IP address.

These categories of personal information may be shared with advertising networks and other companies that facilitate digital advertising, including Meta (Facebook and Instagram), Google (including YouTube and Google Ads), and SimpliFi. We engage in such sharing to facilitate digital advertising that is able to reach people who are most likely to be interested in the services we provide. We do so by allowing third parties to place cookies or other tracking technologies on our website that may collect information about your online activities over time and across different websites or applications. Required Transfers

As Directed by You and With Your Consent

Except as otherwise provided in this Privacy Policy, we share personal information with companies, organizations or individuals outside of Company only at your direction or when we have your consent to do so.

In accordance with applicable law, you may exercise the rights described in this section. Please note that some of the rights may vary depending on your country or state of residence.

Sensitive Personal Information

We collect, process, or share sensitive personal information only when it is strictly necessary to provide or maintain a specific product or service you have requested. Accordingly, we collect certain sensitive personal information, such as health and medical information relevant to program participation, only when strictly necessary to provide our gymnastics instruction services. We do not sell sensitive personal information.

The Right to Access, Correct, and Delete Personal Information

You may have the right to request access to and receive details about the personal information we maintain about you and how we have processed it, correct inaccuracies, get a copy of, or delete your personal information. You may also have the right to withdraw your consent to our processing of your personal information. You may request a list of the specific third parties to which we have disclosed your personal information, or if we do not maintain this information in a format specific to you, a list of categories of third parties to which we have disclosed any consumer’s personal information. You may also opt out of the processing of your personal data for targeted advertising, the sale of your personal data, or profiling in furtherance of solely automated decisions that produce legal or similarly significant effects. These rights may be limited in some circumstances by applicable law.

Typically, we retain your personal information for the period necessary to fulfill the purposes outlined in this Privacy Policy, unless a longer retention period is required or permitted by applicable law. Please note that in many situations we must retain all, or a portion, of your personal information in order to comply with our legal obligations; resolve disputes; enforce our agreements; protect against fraudulent, deceptive, or illegal activity; or for another one of our business purposes.

Responding to Requests

We will respond to your request within 45 days. If we need additional time, we may extend this period by up to 45 additional days, and we will notify you of the extension and the reason for it. We may charge a reasonable fee for requests that are manifestly unfounded, excessive, or repetitive, as permitted by law.

Identity Verification

We will take steps to verify your identity before processing your request. We will not fulfill your request unless you have provided sufficient information for us to reasonably verify you are the individual about whom we collected personal information. We will only use the personal information provided in the verification process to verify your identity or authority to make a request and to track and document request responses, unless you initially provided the information for another purpose.

Authorized Agents

You may designate an authorized agent to opt out of the processing of your personal data for targeted advertising, the sale of your personal data, or profiling on your behalf. You may designate an authorized agent through a browser setting, browser extension, or global device setting that indicates your intent to opt out. If you wish to designate an individual as your authorized agent, we require that your authorized agent provide written proof of their authority to act on your behalf, and we may also require verification of your identity. A parent or legal guardian may exercise these rights on behalf of a child.

Right to Non-Discrimination

We will not discriminate against you for exercising your rights under applicable privacy laws, such as denying you products and services, charging you different rates or prices, or providing a different level of service or quality of products to you.

Right to Appeal

If we decline to take action on your request, we will notify you within 45 days from receipt of your request and provide our justification for declining. You have the right to appeal our decision, and instructions on how to appeal will be included in our response. We will respond to your appeal within 60 days. If we deny your appeal, we will provide you with an online mechanism to contact the Maryland Attorney General’s Consumer Protection Division to submit a complaint.

Marketing Communications

If you no longer wish to receive our marketing and promotional communications, you may opt-out by following the instructions included in each communication.

SMS/Text Messaging

We may send you SMS text messages if you have opted in to receive such messages. We may send transactional messages (such as appointment reminders, class updates, schedule changes, and account notifications) and marketing messages (such as promotional offers, special events, and newsletters). Message frequency varies.

When you provide your mobile phone number and opt in to receive text messages from us, you consent to receive SMS/MMS messages from Dominique Dawes Gymnastics Academy at the mobile number you provide. Consent to receive marketing text messages is not a condition of purchasing any goods or services from us. Message and data rates may apply. Message frequency varies. We collect and use your mobile phone number for the purpose of sending you text messages as described above. We may share your mobile phone number with our service providers solely for the purpose of delivering text messages. We do not sell or share your mobile phone number with third parties for their marketing purposes. Your mobile phone number and related data are retained in accordance with our general data retention practices described in this Privacy Policy.

Carriers are not liable for delayed or undelivered messages. You acknowledge that text messaging may not be available in all areas at all times and may be affected by product, software, coverage, or other service changes made by your wireless carrier.

Retention of Personal Information

We retain personal information only for as long as is necessary for the purposes set out in this Privacy Policy, or as needed to provide the sites and operate our business. We will also retain and use your information to the extent necessary to comply with our legal obligations (for example, if we are required to retain your information to comply with applicable law), resolve disputes, enforce our agreements, and as otherwise described in our Privacy Policy.

Children’s Privacy

Dominique Dawes Gymnastics Academy provides gymnastics instruction and related services primarily to children and minors. We collect personal information about children from their parents or legal guardians, not directly from children themselves. Parents and guardians provide information about their children when enrolling them in classes, camps, or other programs. Children do not have direct access to our member portal; only parents and guardians may log in and use portal features. We do not knowingly collect personal information directly from children under the age of 13 without verifiable parental consent. We do not process the personal data of consumers for targeted advertising where we know or should know the consumer is under the age of 18. If you believe we have inadvertently collected personal information directly from a child under 13 without proper parental consent, please contact us immediately at the contact information provided below, and we will take steps to delete such information.

How We Protect Your Information

We take the security of your personal information very seriously. We use reasonable administrative, physical, and technical safeguards to secure the personal information you share with us.
